GSSD Agreement & Responsibility Contract
This Agreement & Responsibility Contract is between __________________________________ hereinafter referred to as “Client” and Golden State Service Dogs, GSSD, Michelle Magers, Contractor, hereinafter referred to as “GSSD.”
RELEASE OF LIABILITY: Client agrees to release, discharge, and hold harmless GSSD and any affiliated parties from any and all injury, loss, or damage to self or property (Client’s dog), in the broadest possible sense for any services that Client, Client’s dog or Client’s family voluntarily participate in, including but not limited to: dog training, consultation, e-services, homeschool/daycare, boarding, spa/grooming, or other services. Client assumes full liability and shall bear all expenses for any personal injury or damages to other persons, animals, property, and, if applicable, to Client and Client’s family members. Client is ultimately responsible for all actions of their dog(s). Client agrees that they are fully liable and responsible for their dog’s health needs, safety, behavior, and quality of life, and will ensure that their dog has current vaccines, regular veterinarian checkups, parasite preventatives, and is kept well-groomed. Client understands that GSSD does not provide liability/health insurance or pet medical coverage to Client. If Client wants such coverage, they are responsible for researching, purchasing, and maintaining such coverages from an outside licensed provider of their selection.
HOMESCHOOL SERVICES: Homeschool services includes, but is not limited to: dog training, doggy daycare, grooming/spa and boarding. Under the best circumstances, Homeschool services are inherently risky, despite the introduction of other dogs and play, injuries and sickness can still occur, including, but not limited to: insect bites/injuries or possible ingestion of plant/dirt/rocks and other items. Client agrees to release, discharge, and hold harmless GSSD and any affiliated parties from any and all injury, loss, or damage to self or property (Client’s dog), in the broadest possible sense for Homeschool services. In addition, GSSD is not liable for any damages or injuries related to severe weather/other emergencies that are not within GSSD control. Client understands that GSSD may not have supervision at the Homeschool site 24/7. However, kennels and baby-gated zones are provided and monitored by cameras.
GROUP EVENTS: Client understands that GSSD has limited enrollment in group events and Client is responsible for attending the events they have signed up for. GSSD does not offer any event makeups/refunds/enrollment changes within 72 hours before a group event.
GSSD DOG HEALTH STANDARDS: Client understands that they must follow the GSSD Dog Health Standards that are posted on the GSSD website, and violation of these standards will result in the immediate removal of Client and their dog from events/services without reimbursement/compensation. I understand that GSSD reserves the right to refuse or terminate services to any Client at any time for any reason.
GSSD HOURLY RATE: The hourly rate charged by GSSD is $110. GSSD offers pre-paid packages that discount the hourly rate. Refunds/exchanges may only be approved by GSSD within 30 days of the original purchase and will revert to the hourly rate of $110, refunded to the original method of payment received.
PAYMENT: Client agrees to pay the full amount for pre-paid packages before services begin and GSSD is not obligated to perform any services until payment is rendered. Client agrees to complete all pre-paid packages within 3 months of the date purchased, or Client voids any unused services. Client understands that any returned checks or other forms of payment will result in a fee of $30.00 from GSSD on top of any fees charged by Client’s financial institution.
CANCELLATION POLICY: Client understands that if they need to cancel a scheduled appointment/service for any reason, Client agrees to contact GSSD at least 24 hours in advance. Client agrees that violation of this policy may result in being charged the full cost of the appointment/service. GSSD does not offer any returns on services rendered. Severe weather/other emergencies may require the cancellation of services by GSSD. In the event of such cancellations, services will be rescheduled at no additional cost.
COVID-19: If Client agrees to voluntarily meet with GSSD for any in-person services, Client accepts responsibility for their own health and compliance with the CDC, local, state and federal requirements. Client understands that by coming to any in-person services voluntarily, they are assuming the risk of exposure to COVID-19. Client agrees to release, discharge, and hold harmless GSSD and any affiliated parties from any and all injuries, including, but not limited to: all causes of action, claims, demands, damages with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from costs, expenses and compensation for damages caused by COVID-19.
MANDATED REPORTER: Client understands that GSSD will keep all their personal information confidential unless they submit a written request to release said information. However, Client understands that GSSD is a mandated reporter and if Client reports any information of harm to themselves or others, GSSD is mandated to report this information to appropriate authorities immediately.
MEDIA RELEASE: Client gives permission to GSSD to use, reproduce, and/or publish photographs, videotapes, stories, or any likeness, including that of Client’s dog(s), which may pertain to Client for publicity and/or promotions. Client grants GSSD any and all rights to said use without compensation. Client releases GSSD from any financial or legal responsibility for the use of such media, social media, website relation, promotional, or educational materials.
GSSD WEBSITE: The GSSD website does collect personal data (cookies, analytics, etc.) and has posted the full Personal Data Collection Compliance Statement on the GSSD website.
COPYRIGHT: The information on the GSSD website, along with all learning/teaching materials, curriculum, and handouts are under copyright by GSSD. Reproduction and/or distribution of any content without written permission from GSSD is prohibited and punishable by law.
GSSD RESOURCES: GSSD resources are for Client convenience/general overview only; it is not veterinary medical advice and should not take the place of seeking professional veterinarian aid/consults. GSSD does not endorse any specific products and are not liable for products/services Client choses to purchase, use, receive or decline. Client agrees to use safety and common sense when using products/services on their dog and only use products that work safely with their dog’s diet, health, and medical needs. Client agrees to consult their dog’s veterinarian for recommendations, and any concerns they may have regarding their dog’s health/wellbeing. If Client suspects their dog is injured, ill, or having a medical or life-threatening emergency, Client agrees to take their dog to a veterinarian or nearest 24-hour pet hospital so the problem can be identified, and appropriate treatment can be started.
AMENDMENTS AND WAIVER This Agreement may not be amended or terminated except by an instrument in writing, signed by each of the parties. No failure to exercise and no delay in exercising any right, remedy, or power under this Agreement shall operate as a waiver.
BINDING EFFECT. This Agreement shall be for the benefit of, be enforceable by, and be binding on the Parties and their heirs, personal representatives, assigns, and any other successors in interest. The terms of this Agreement shall not benefit any other person or entity, except as specifically enumerated in the Agreement.
ENTIRE AGREEMENT. This Agreement is intended to be the final, complete and exclusive agreement of the Parties on the matters it covers. It superseded any previous or contemporaneous oral or written agreements between the Parties with respect to these matters. There are no representations, warranties, promises, or agreements with respect to these matters, except as set forth in this Agreement.
SEVERABILITY. If a court holds any provision of this Agreement to be invalid, unenforceable, or voice, the remainder of this Agreement shall remain in full force and effect.
GOVERNING LAW. This Agreement shall be governed by and construed in accordance with the law of the State of California.
INTERPRETATION. This Agreement shall be construed as a whole, according to its fair meaning, and not in favor of or against any Party. Section headings are used for reference purposes only and should be ignored in the interpretation of the Agreement.
ACKNOWLEDGMENTS. Each Party acknowledges that he or she respectively is fully informed as to the facts relating to the subject matter of the Agreement, and as to the rights and liabilities of both Parties, enters into this Agreement voluntarily, free from fraud, undue influence, coercion, or duress of any kind and has read, considered and understands each provision of this Agreement.
DISPUTE RESOLUTION. If a dispute arises under this Agreement, Client and GSSD agree first to try and resolve the dispute through good-faith negotiation. Should negotiation fail either to transpire or to resolve the dispute within thirty (30) days, both parties agree to attempt mediation before filing a lawsuit. Both parties shall split the cost of mediation equally.
ATTORNEY FEES. If any Party brings any action against any other party with respect to the enforcement or interpretation of this Agreement, then the prevailing party in such action shall be entitled to an award of its costs of litigation, including reasonable attorneys’ fees.
Personal Data Collection Compliance Statement
Who We Are: Our website address is: https://goldenstateservicedogs.com.
What Personal Data We Collect and Why We Collect It: We may collect personal data, such as name, email address, personal account preferences; transactional data, such as purchase information; and technical data, such as information about cookies. If you complete our Contact Us form with sensitive personal data, such as data concerning health, that is also collected to better serve your needs with the package you purchase or consider purchasing. Personal data is not just created by a user’s interactions with our site, but also generated from technical processes such as contact forms, comments, cookies, analytics, and third party embeds. By default WordPress does not collect any personal data about visitors, and only collects the data shown on the User Profile screen from registered users. However, some of plugins may collect personal data. We collect information about you during the checkout process on our store.
What We Collect and Store: While you visit our site, we’ll track:
• Products you’ve viewed: we’ll use this to, for example, show you products you’ve recently viewed
• Location, IP address and browser type: we’ll use this for purposes like estimating taxes and shipping
• Shipping address: we’ll ask you to enter this so we can, for instance, estimate shipping before you place an order, and send you the order!
We’ll also use cookies to keep track of cart contents while you’re browsing our site.
When you purchase from us, we’ll ask you to provide information including your name, billing address, shipping address, email address, phone number, credit card/payment details and optional account information like username and password. We’ll use this information for purposes, such as, to:
• Send you information about your account and order
• Respond to your requests, including refunds and complaints
• Process payments and prevent fraud
• Set up your account for our store
• Comply with any legal obligations we have, such as calculating taxes
• Improve our store offerings
• Send you marketing messages, if you choose to receive them
If you create an account, we will store your name, address, email and phone number, which will be used to populate the checkout for future orders.
We generally store information about you for as long as we need the information for the purposes for which we collect and use it, and we are not legally required to continue to keep it. For example, we will store order information for 10 years for tax and accounting purposes. This includes your name, email address and billing and shipping addresses.
We will also store comments or reviews, if you choose to leave them.
Who On Our Team Has Access: Members of our team have access to the information you provide us. For example, both Administrators and Shop Managers can access:
• Order information like what was purchased, when it was purchased and where it should be sent, and
• Customer information like your name, email address, and billing and shipping information.
Our team members have access to this information to help fulfill orders, process refunds and support you.
What We Share with Others: We may data with, but may not be limited to, analytics, marketing, payment gateways, shipping providers, and third party embeds. We share information with third parties who help us provide our orders and store services to you.
Payments: We accept payments through Square, built with Storefront and WooCommerce. When processing payments, some of your data will be passed to Square, built with Storefront and WooCommerce, including information required to process or support the payment, such as the purchase total and billing information.
Comments: When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection. An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.
Media: If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
Contact Forms: In the contact forms, we collect the information users submit, like name, address, phone number, email, dog’s name, breed, age/DOB, allergies, who referred and any additional messages the user writes in. We collect this information for customer service needs. We keep contact form submissions for a certain period for customer service purposes, but do not use the information submitted through them for marketing purposes.
Cookies: If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year. If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser. When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed. If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.
Embedded Content from Other Websites: Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.
Analytics: By default WordPress does not collect any analytics data. However, many web hosting accounts and plugins collect some anonymous analytics data.
Who We Share Your Data With: By default WordPress does not share any personal data with anyone. If you checkout with Storefront, WooCommerce and Square will collect your personal date, including payment processing.
How Long We Retain Your Data: If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.
For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
What Rights You Have Over Your Data: If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
Where We Send Your Data: Visitor comments may be checked through an automated spam detection service.

However, I understand that GSSD owners/employees act as mandated reporters and if I report any information of harm to myself or others, Golden State Service Dogs will report this information to appropriate facilities immediately.
